We’ve received many questions from our German and European customers about the legal implications of moving to Cloud. If you find yourself in this category, this article can help shed light on how to proceed.

Many Atlassian customers in Germany (or Europe) are asking themselves if they need to find an alternative for their Atlassian tools. Atlassian Cloud has a number of unknowns at the time of writing: Privacy Shield is not working, Standard Contractual Clauses (SCC) is uncertain, no clear solution for data residency, etc.

If you think Cloud is a blocker for your team, think again: If there are blockers at this time that keep you from moving to Atlassian’s Cloud products, it is likely that Atlassian will remove blockers and fix them before the Server products go out-of-support in 2024.

What you should do now:

  • Check your current Server licenses: You will only be able to buy new Server licenses until .
    ⚠️ Attention: You won’t be able to upgrade a Starter License to a higher user tier after , because Atlassian considers that a new license.

  • Evaluate your migration options: Deciding whether you go to Cloud or if Data Center is the next best step for you and your team. That said, there are many unknowns in this decision, so you may have to re-evaluate over time.

  • Once you’ve decided, migrate quickly: Atlassian provides loyalty discounts for existing customers who have decided to move to Cloud or Data Center. The discounts of the loyalty program are higher the earlier you migrate – so take advantage! Get the Best Price for Your Atlassian Licenses

  • When you migrate to Cloud, make use of the migration trial licenses: Atlassian offers up to 12 months of free licenses. You can also spin up small instances using the Free plan for testing, trainings, and more.

  • If you are postponing the migration:(for whatever reason), make sure you have upgraded your Server license to the right user tier. After you won’t be able to upgrade (or downgrade) your Server licenses.
